Ordnance Survey Maps and Planning Applications - Government of Ireland copyright protects all works made by the Government or by an officer or servant of the Government in the course of his/her duties. This statement includes Ordnance Survey Ireland (OSI) maps, publications and data. When Ordnance Survey Ireland and Land Registry maps are photocopied without prior written permission from OSI, copyright law is then infringed. (and the acceptance of this infringed material is akin to receiving stolen goods.).
Large numbers of Architects, Engineers, Surveyors, Auctioneers and Solicitors have Ordnance Survey Ireland licences so as not to infringe copyright law. All licences numbers start with the appropriate first two letters of the profession of the agent and end with the last two digits of the current year. Meath Local Authorities request that you submit maps with planning applications in accordance with copyright law.
Tree Felling Licences and Planning Permissions - Under Section 37 of the Forestry Act, 1946, with certain exceptions, it is illegal to uproot a tree over ten years of age or cut down a tree of any age unless notice of intention to do so has been given in accordance with the Act.
If the planning permission issued is in respect of an area located within the boundaries of a town, borough, or city council area, then a felling licence is not required. However, with very few exceptions, if it is proposed to fell trees anywhere else a licence is required, irrespective of whether planning permission is held or not. Failure to obtain a Tree Felling Licence can result in a criminal conviction. In cases where a landowner is convicted of illegal felling, the Department of Agriculture, Fisheries and Food makes a legally binding order to replant the trees that have been felled. Where planning permission has been granted in respect of such a site, a replanting order may be in direct conflict with the planning permission. A replanting order may affect the landowners right to proceed with the building development, or may cause the owner to suffer the substantial extra cost of having to buy alternative planting land. Not obtaining a Tree Felling Licence when required can have serious consequences.

Exempted Development
All development requires planning permission unless it is an exempted development. All exempted developments are listed in the Planning and Development Regulations 2001, as amended. Most of the exemptions contain certain conditions and limitations. If the terms of conditions and limitations cannot be complied with, the development cannot be considered an exempted development.
Section 5 Referral or Exemption Declaration
If a question arises as to whether or not a development is or is not exempted development, a person may apply to the planning authority for a declaration on the question. This is known as a section 5 referral or an Exemption Declaration.
In order to apply for a section 5 referral it is necessary for the applicant to submit, application form, fee of €80.00, location map, drawings of the proposed development in question, full details and description of the proposed development.
The planning authority shall issue the declaration, within 4 weeks of the receipt of the request.
The planning authority may require further information to be submitted to enable the authority to issue the declaration. In this regard, a declaration shall issue within three weeks of the receipt of this further information.

Certificate of Exemption (Social & Affordable Housing)
Under Part V, Section 96 of the Planning and Development Act 2000 as amended, all residential developments on residential zoned lands or zoned lands where residential use is a pre-dominant use e.g. mixed use zoning, are required to provide social and affordable housing.
Under Ssction 97 of the Act, a person may, before applying for permission in respect of development consisting of
(a) the provision of 4 or fewer houses, or
(b) for housing on land of 0.1 hectacres or less,
apply to the Planning Authority concerned for a certificate stating that Section 96 shall not apply to a grant of permission in resepct of the development concerned and accordingly where the Planning Authority grants a certificate under Section 97, Section 96 shall not apply to a grant of permission in respect of the development concerned.
